125.78 feet; thence North 12° 34' 00" East a distance of 150 feet; <br />thence South 77° 26' 00" East a distance of 70 feet; thence North <br />12° 34' 00" East a distance of 145 feet to an iron pin on the south <br />right of way line of Portsmouth Boulevard, the point of beginning. <br />Reference is hereby made to the aforesaid plat recorded in Map <br />Book 15 at page 174 for a more particular description of the <br />property described herein. <br />IT BEING Parcel One of that certain property conveyed from <br />Frances R. Johnson, Trustee to Manor Village, LLC by Deed of <br />Gift dated October 21, 2014 and recorded in the Portsmouth <br />Circuit Court Clerk's Office as Instrument Number 140009898. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) No more than four (4) trucks shall be parked on the 6229 Portsmouth <br />Boulevard property at any given time in conjunction with the use. <br />(b) The use shall be confined to Suite 6229 of the 6229 Portsmouth Boulevard <br />property. <br />(c) The use shall be operated in compliance with the following use - specific <br />standard in accordance with Section 40.2- 217(G)(7)(a) of the Zoning <br />Ordinance: <br />(1) All newly established new and used vehicle sales uses shall be <br />prohibited from parking or displaying vehicles in the required <br />buffer between the front lot line and any vehicle use area. <br />(d) Prior to commencing the use, a Zoning Permit must be obtained from the <br />City's Zoning Administrator and a Certificate of Occupancy must be <br />obtained from the Department of Permits and Inspections. <br />(e) The maximum occupancy load, including patrons and employees, shall <br />comply with the limits set by the Building Official. <br />(f) All required local, state, and federal licenses and permits must be obtained <br />prior to commencement of the use and must be maintained in effect during <br />the operation of the use. <br />(g) All taxes /fees associated with the property or the use shall be paid when <br />due, as determined by the City Treasurer. <br />7. REVOCATION OF PERMIT: Violation of any of the conditions set <br />forth herein may serve as grounds for revocation of the use permit by City Council. <br />
