kennel at 2880 B Airline Boulevard, located on a portion of Tax Parcel 0577 -0200, said <br />Tax Parcel being more particularly described as: <br />UP -20 -01 <br />Victory West Shopping Center <br />2884 Airline Boulevard <br />(Tax Parcel 0577 -0200) <br />ALL THAT certain lot, piece or parcel of land situate, lying and <br />being in the City of Portsmouth, Virginia, and being known, <br />numbered and designated as "Parcel B -1 ", as shown on that certain <br />plat entitled, "Resubdivision of a Parcel of Land located at 2850 <br />Airline Boulevard (Instr. #060005183) and Parcel B, Subdivision <br />of Collinswood. Section One (M.B. 3 P. 94) Portsmouth, <br />Virginia ", made by DKT Associates Land Surveyors, dated June <br />30, 2016, which said plat is duly recorded in the Clerk's Office of <br />the Circuit Court of the City of Portsmouth. Virginia, in Map Book <br />24 at page 137, to which reference is hereby made for a more <br />particular description of said property. <br />IT BEING the same property conveyed to Victory West Thrill <br />Park, LLC by Deed from Zway 11, L.L.C. dated May 3, 2017 and <br />recorded in the Portsmouth Circuit Court Clerk's Office as <br />Instrument Number 170004603. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The outdoor kennel use is only permitted in the area of the property shown <br />on the approved site layout plan and shall be located as indicated on the <br />approved site layout plan. <br />(b) No more than 14 (7 per outdoor play area) dogs shall be present in the <br />outdoor kennel area at any one time. <br />(c) The kennel area, including fencing, shall be maintained in a safe and <br />sanitary condition. <br />(d) All animal waste from the outdoor dog kennel shall be collected and <br />disposed of in a lawful manner on a daily basis. <br />(e) The applicant shall obtain all required local, state, and federal licenses and <br />permits prior to commencing operation, and the licenses and permits shall <br />be kept current at all times during operation of the use. <br />
