UP -19 -20 <br />609 Columbia Street <br />(Tax Parcel 0025 -1290) <br />ALL THAT certain lot, piece or parcel of land, lying, being and <br />situate in the City of Portsmouth, Virginia and being more <br />particularly bounded and described as follows: <br />BEGINNING at a point on the south side of Columbia Street 90 <br />feet west of the southwest intersection of Columbia Street and <br />Washington Street and running thence 113 feet south and parallel <br />with Washington Street to a pin, then 90 feet west and parallel with <br />Columbia Street to a pin, thence 113 feet north parallel with <br />Washington Street to Columbia Street, and thence running 90 feet <br />east along Columbia Street to the point of beginning. <br />IT BEING all that certain property conveyed by RBA -LLC, a <br />Virginia limited liability company, to ICS Home Investments, Inc._, <br />a Virginia corporation, by Deed dated October 11, 2019 and <br />recorded in the Portsmouth Circuit Court Clerk's Office as <br />Instrument Number 190010564. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The number of dwelling units on the property shall not exceed four (4). <br />(b) The design, materials and layout of the development shall be in substantial <br />compliance with the Downtown Design Committee (DDC) Certificate of <br />Appropriateness approvals on August 6, 2019 and February 4, 2020. <br />(c) The proposed development shall be in substantial compliance with the <br />concept plan entitled Minor Subdivision (Y'609 Colinnbia Street, <br />Portsmouth, Virginia, prepared by Pennoni Associates Inc. dated January <br />28, 2020 and the rendered concept elevations titled Columbia Street <br />Townhouses prepared by GMF+ Associates dated January 27, 2020, <br />except where modifications may be required to comply with applicable <br />local, state and federal codes and regulations. <br />(d) The development shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local government, including but not <br />limited to the Virginia Uniform Statewide Building Code. <br />(e) All taxes /fees associated with the property and/or the proposed use shall <br />be paid when due, as determined by the City Treasurer. <br />
