survive the completion or termination of this Agreement and the completion of the construction <br />of Norfolk's NRWM and Portsmouth's NFWM. <br />14. DISPUTE RESOLUTION: The Engineering Managers of the respective cities <br />shall make every effort to informally resolve disputes with respect to this Agreement. If the <br />Engineering Managers are unsuccessful, either party may request non - binding mediation. The <br />parties shall endeavor to agree to a single mediator to mediate the dispute in a session not to <br />exceed one half -day in length; the parties will split the costs of mediation. Should the mediation <br />be unsuccessful, a formal proceeding may be instituted by either party in the Norfolk Circuit <br />Court. In the event of a dispute regarding payment of any Non - Reimbursable Costs by <br />Portsmouth to Norfolk, Portsmouth agrees to deposit the disputed amount with an escrow agent <br />selected by both cities, or provide a bond in such amount, pending the resolution of the dispute. <br />15.
