City of Portsmouth Zoning Ordinance 11/6/2020 <br />Article I. — General Provisions <br />Sec. 40.2 -106 — Zoning for Areas Previously Unzoned <br />(D) In accordance with Code of Virginia § 15.2 -2309, the Board of Zoning Appeals (BZA) shall <br />hear and decide applications for interpretation of the Zoning Map where there is any <br />uncertainty as to the location of a district boundary. <br />Sec. 40.2 -106 — Zoning for Areas Previously Unzoned <br />(A)Any area incorporated into the City after the effective date of this Ordinance or in every case <br />where property has not been specifically included within a zoning district, the land shall be <br />automatically designated as Conservation (C) until such classification is changed by an <br />amendment to this Ordinance in accordance with Sec.40.2 -532 Zoning Text and Map <br />Amendments. <br />(B) The Planning Commission shall prepare and present to City Council a zoning plan for the new <br />area within six (6) months of the effective date of the incorporation of the area. <br />Sec. 40.2 -107 — Relationship with other Code Chapters <br />(A)Standards for compliance with Code of Virginia § 62.1- 44.15:67 -79., the Chesapeake Bay <br />Preservation Act, are located in City Code Ch. 9.1 Chesapeake Bay Preservation Area Overlay <br />District. <br />(B) Standards for floodplain management and protection, in accordance with Code of Virginia § <br />10.1 -600, et seq., are located in City Code Ch. 14.1 Flood Protection. <br />(C) Whenever any provision of this Ordinance refers to or cites a section of the Code of Virginia <br />(1950), as amended, and that section is later amended or superseded, this Ordinance shall be <br />deemed amended to refer to the amended section or the section that most nearly corresponds <br />to the superseded section. <br />Sec. 40.2 -108 — Fees <br />(A)The Zoning Administrator is authorized to collect fees to cover the cost of processing <br />applications, issuing permits, and other expenses associated with the administration of this <br />Ordinance. <br />(B) All fees under this Ordinance shall be collected in accordance with the most recent fee schedule <br />adopted by City Council set forth in Appendix A of the City Code. <br />Sec. 40.2 -109 — Uses and Lots Generally <br />(A) Conformance with Ordinance <br />(1) No building or structure shall be erected, and no existing building shall be moved, altered, <br />added to, or enlarged, nor shall any land, building, or structure be used, occupied, designed, <br />or arranged to be used for any purpose or in any manner not in conformance with the <br />regulations of this Ordinance. <br />(2) Except as otherwise expressly permitted by this Ordinance, every building hereafter <br />erected shall be located on a lot as defined in Article V1 Definitions. <br />(B) Uses Not Specifically Listed <br />Page 3 <br />
