�R�I�A 20 -12$ AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA BY ADOPTING AN AMENDED AND RESTATED ZONING ORDINANCE AS A NEW CHAPTER 40.2 AND BY REPEALING THE EXISTING CHAPTER 40.1. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the Code of the City of Portsmouth, Virginia is amended by adopting a new Chapter 40.2 in the form attached hereto as Exhibit A. 2. That Chapter 40.2 is designated as the Zoning Ordinance of the City of Portsmouth, Virginia. 3. That the Code of the City of Portsmouth, Virginia is amended by repealing Chapter 40.1 in its entirety. 4. That the following transitional rules are adopted: (a) Except for variance applications, applications for zoning or development approvals that were accepted on or before November 20, 2020 shall be reviewed and processed in accordance with the development standards of Chapter 40.1. (b) Except for variance applications, applications for zoning or development approvals that were or are accepted after November 20, 2020 shall be reviewed and processed in accordance with the development standards of Chapter 40.2. (c) Regardless of the date of acceptance of the application, variance applications that are decided by the Board of Zoning Appeals prior to February 1, 2021 shall be subject to, and determined in accordance with, the standards of Chapter 40.1. (d) Regardless of the date of acceptance of the application, variance applications that are decided by the Board of Zoning Appeals on or after February 1, 2021 shall be subject to, and determined in accordance, the standards of Chapter 40.2. 5. That Sections 1 through 3 of this ordinance shall take effect on February 1, 2021. 6. That Section 4 of this ordinance shall take effect on the date of adoption.
