ORDINANCE 2022 -13 <br />AN ORDINANCE TO AMEND AND REORDAIN ARTICLE I OF CHAPTER 6 OF THE <br />CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) REGARDING THE <br />REGULATION OF VESSELS IN THE NORTH HARBOR AND HIGH STREET INLET <br />AND ALONG THE PORTSMOUTH SEAWALL BY AMENDING SECTION 6 -7 TO <br />CLARIFY THAT THE MOORING OF CERTAIN VESSELS USED FOR THE <br />OPERATION OF A PUBLIC FERRY SERVICE IS PERMITTED. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Article I of Chapter 6 of the Code of the City of Portsmouth, Virginia <br />(2006), as amended ( "Boats and Waterways; in General "), is hereby amended and reordained by <br />modifying subsection (b) of Section 6 -7 as shown below to clarify that the mooring of certain <br />vessels used for the operation of a public ferry service is permitted. Except as shown below, <br />Section 6 -7 is not otherwise modified: <br />Sec. 6 -7. - City, piers, wharves, docks, landings, etc.; regulation. <br />(b) The following rules and regulations are established for vessels in the North Harbor and the <br />High Street Inlet and along the Portsmouth Seawall: <br />(1) No boater less than 18 years of age shall moor a vessel in the North Harbor or the High <br />Street Inlet. <br />(2) The mooring of recreational vessels in the Elizabeth River along the Portsmouth <br />Seawall is prohibited. <br />(3) Vessels shall tie up or moor only to the docks, not to other vessels. "Rafting up" is not <br />permitted. <br />(4) The anchoring of vessels is not permitted in the North Harbor or the High Street Inlet <br />unless the vessel is also tied up to the dock. <br />(5) Except for ferry vessels being utilized for the operation of the HRT public ferry service <br />No no vessel shall be tied up or moored in the North Harbor or the High Street Inlet for <br />more than 36 continuous hours or a total of 72 hours within any 30 -day period. <br />(6) Except for ferry vessels being utilized for the operation of the HRT public ferry service <br />the mooring of vessels shall be on a first come, first serve basis, and no spaces shall <br />be "held" or reserved for vessels not actually present. <br />(7) Except for ferry vessels being utilized for the operation of the HRT public ferry service, <br />moored vessels shall not exceed 40 feet in length. The portion of the High <br />Street Inlet adjacent to the flagpole shall be utilized only by vessels 35 -40 feet in length. <br />(8) The discharge or pumping out of sanitary facilities into the North Harbor or the High <br />Street Inlet is strictly prohibited. <br />2. That this ordinance shall take effect immediately on the date of its adoption. <br />
