��1LN�INY�IILi ;121 <br />AN ORDINANCE TO CLOSE VILLAGE WAY AND CORPORATE DRIVE <br />EXTENDING NORTHWEST FROM FREEDOM AVENUE AND LOCATED BETWEEN <br />VICTORY BOULEVARD, CAVALIER BOULEVARD AND MCLEAN STREET. <br />WHEREAS, Street Closure Application S -20 -01 has been filed by the Economic <br />Development Authority of the City of Portsmouth, Virginia to close Village Way and Corporate <br />Drive extending northwest from Freedom Avenue and located between Victory Boulevard, <br />Cavalier Boulevard and McLean Street; and <br />WHEREAS, the Planning Commission, at a meeting held on November 17, 2020, <br />recommended approval of the closure and vacation of the said areas of Village Way and <br />Corporate Drive, which are shown more particularly in cross- hatching on that certain "Exhibit of <br />Village Way Street and Corporate Drive Closure ", prepared by American Engineering, dated <br />August 26, 2020, and attached hereto as Exhibit A (the "Vacated Area"): and <br />WHEREAS, notice of the proposed closure and vacation has been given to the adjoining <br />property owners in accordance with Section 15.2 -2006 of the Code of Virginia, as amended; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that the Vacated Area is hereby closed and vacated as a public street and right -of -way; <br />and <br />BE IT FURTHER ORDAINED that the City of Portsmouth reserves an easement in the <br />Vacated Area for the installation, operation, maintenance and replacement of public and /or <br />private utilities, which said easement may be vacated, in whole or in part, by the City Manager at <br />such time as he may in his discretion deem appropriate and in the best interest of the City of <br />Portsmouth, and that the City Manager is authorized to execute and deliver one or more <br />instruments as he may deem appropriate and necessary to cause such vacation and release; and <br />BE IT FURTHER ORDAINED that the City Manager is hereby authorized to execute <br />and deliver such deeds or other documents as he may deem appropriate and necessary to <br />quitclaim or otherwise convey such other rights or property interests, if any, as the City may <br />have in the Vacated Area to the adjoining property owners. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at an electronic meeting <br />held on November 24, 2020. <br />Teste: <br />City Clerk <br />
