1 29207-103 ZONING AMENDMENT ORDINANCE Z -20 -05 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance, which now zones as UR -H, High Density Urban Residential the property described in Petition for Zoning Amendment Number Z- 20 -05, is hereby amended and changed so as to show said property zoned as NMU, Neighborhood Mixed Use, and that said property is hereby zoned as NMU, Neighborhood Mixed Use. 7 That tj�� »r »nrt� �ffe�tPr h�' thic nr�ip r�fa h�' hei» T :�Nl d f;,- [ `T2 _I I High Density Urban Residential to NMU, Neighborhood Mixed Use is furthermore Z -20 -05 3509 Towne Point Road (Tax Parcel 0829 -0010) ALL THAT certain lot, piece or parcel of land, situate, lying and being in Portsmouth, Virginia, being known, numbered and designated as Parcel "B" as shown on a certain plat entitled "Plat Showing Survey to Portion of Property Designated as Parcel `A' to be conveyed to Ted Franklin and Barbara Anne Carpenter by Alton Watterson and Elizabeth Clark ", made August 18, 1958, by Ball - Hassell and Associates, Surveyors and Engineers, and duly recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Deed Book 1267, at page 128, with the deed from Alton Watterson Clark, et ux, to Ted Franklin Carpenter, et ux, dated August 21, 1958, said plat being recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia, in Deed Book 1267, page 130. LESS AND EXCEPT that portion of property conveyed to the Commonwealth of Virginia by instrument dated April 21, 1980 and recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia on June 9, 1980, in Deed Book 1888, page 257 and recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia on June 5, 1980, in Deed Book 783, page 740. IT BEING all that certain property conveyed by Deed from Croatan Western Branch, LLC to Indian River Road Properties, LLC dated July 6, 2018 and recorded in the Portsmouth Circuit Court Clerk's Office as Instrument Number 180006915.
