Subsection 18.8 entitled "Evidence of Insurance" is amended to read in its entirety as follows: Evidence of Insurance. All insurance shall meet the following requirements: (a) The Grantee shall furnish the City a certificate or certificates of insurance showing the type, limits required, effective dates and date of expiration of the policies. (b) Upon receipt of notice from its insurer(s) the Grantee shall provide the City with thirty (30) days' prior written notice of cancellation of any required coverage. (c) The required certificate or certificates of insurance shall include the City of Portsmouth, its officers, employees and volunteers as additional insureds as their interest may appear under this Agreement on the commercial general liability, commercial automobile liability and umbrella liability insurance. (d) Any insurance company providing coverage under this Agreement must be authorized to do business in the Commonwealth of Virginia. 3. Ratification. Grantee and City hereby ratify and affirm the Franchise Agreement as modified by this Rider, and confirm that Franchise Agreement, as modified by this Rider, is a subsisting obligation that remains in full force and effect. 4. Successors and Assigns. This Rider shall inure to the benefit of and be binding upon the parties hereto and their respective successors and assigns. 5. Governing Law. This Rider shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Virginia. This Rider is executed under seal. 6. Counterparts. This Rider may be executed in counterparts or with the use of counterpart signature pages, and all such counterparts, taken together, shall constitute a single instrument.
