(a) Micro - Wireless Facilities: Install, place, maintain, remove or replace Micro - Wireless Facilities <br />that are suspended on cables or lines that are strung between existing Utility poles within the <br />Public way in compliance with national safety codes. All such installation, placement, <br />maintenance, removal or replacement of Micro - Wireless Facilities shall be in strict <br />accordance with all requirements of Chapter 32 of the City Code, including without limitation <br />Article II ( "Right -of -Way Permit ") and Article XI ( "Wireless Facilities ") thereof, as the same <br />may be amended from time to time. <br />(b) Existing Structures: Co- locate Wireless Facilities on Existing structures within the Public way <br />(subject to Grantee obtaining permission of the owner of the Existing structure to Co- locate). <br />All Co- location of Wireless Facilities on Existing structures shall be in strict accordance with <br />the requirements of Chapter 32 of the City Code, including without limitation Article XI <br />( "Wireless Facilities ") thereof, as the same may be amended from time to time. For purposes <br />of clarity, this provision applies to all Replacement Utility Poles deployed by Grantee in the <br />Public way. <br />(c) City Facilities: Co- locate Wireless Facilities on City Facilities within the Public way (subject to <br />Grantee obtaining permission of the City as provided in Article XI ( "Wireless Facilities ") of <br />Chapter 32 of the City Code). All Co- location of Wireless Facilities on City Facilities shall be <br />in strict accordance with the requirements of Chapter 32 of the City Code, including without <br />limitation Article XI thereof, as the same may be amended from time to time. <br />(d) New Wireless Support Structures: Place new Wireless Support Structures within the Public <br />way and locate Wireless Facilities thereon (subject to Grantee obtaining permission of the <br />City as provided in Article XI ( "Wireless Facilities ") of Chapter 32 of the City Code). All <br />placement of new Wireless Support Structures shall be in strict accordance with the <br />requirements of Chapter 32 of the City Code, including without limitation Article IV ( "Street <br />Poles ") and Article XI thereof, as the same may be amended from time to time. <br />Section 7. Compensation. For the rights and privileges granted herein, Grantee shall pay to the <br />City an annual user fee for each Wireless Facility installed in the Public ways of the City. The amount of <br />the annual user fee shall be: <br />(a) No charge for installation, placement, maintenance or replacement of Micro - Wireless <br />Facilities that are suspended on cables or lines that are strung between existing Utility poles. <br />(b) No charge for Co- location of Wireless Facilities on Existing structures within the Public <br />way (other than Existing structures that are City Facilities). <br />(c) $50 (or the maximum amount permitted by law, whichever is less) per City Facility for Co- <br />location of Wireless Facilities on City Facilities within the Public way. <br />(d) $1,000 (or the maximum amount permitted by law, whichever is less) per Wireless <br />Support Structure for new Wireless Support Structures placed within the Public way. <br />7.1 The annual user fee shall be paid to the City within 90 days after the completion of construction <br />and prorated for the remainder of the City's fiscal year which ends June 30. Each year thereafter, <br />the user fee shall be paid 45 days prior to the end of the City's fiscal year. <br />7.2 Each payment shall be accompanied by a statement showing the manner in which the user fee <br />was calculated and with a cover letter on company letterhead, which contains a statement by a <br />representative of Grantee certifying that the information and computation of the payment amount <br />shown are true and accurate to the best of his or her knowledge and belief. <br />-4- <br />
