i. Permittee shall have all required insurance coverage in effect; <br />ii. Permittee shall deliver to the City certificates of insurance for all lines of coverage, or other <br />evidence satisfactory to the City in its sole discretion. The Permittee shall be responsible <br />that such coverage evidenced thereby shall not be substantially modified or canceled <br />without 30 days prior written notice to the City; <br />iii. Permittee shall deliver to the City endorsements to the policies which require the City and <br />its officials, officers, employees, agents and volunteers be named as "additional insured ". <br />Policies which require this endorsement include: Commercial General Liability and Auto <br />Liability. Such endorsements must be approved by the City, and <br />iv. Upon the request of the City, Permittee shall provide any other documentation satisfactory <br />to the City in its sole discretion, evidencing the required insurance coverage, including but <br />not limited to a copy of the insurance policy and evidence of payment of policy premiums. <br />h. Waiver of Subrogation: To the fullest extent permitted by law, the Permittee agrees to release <br />and discharge the City of and from all liability to the Permittee, and to anyone claiming by, through <br />or under the Permittee, by subrogation or otherwise, on account of any loss or damage to tools, <br />machinery, equipment or other property, however caused. <br />VII. Modifications <br />The City reserves the right to modify any and all provisions of the Pilot Program or these <br />Regulations as deemed appropriate in her discretion. Upon receiving notice of a modification, <br />each Permittee shall promptly comply. <br />VIII. Revocation <br />The City shall have the right to revoke any Permit for failure to comply with these Regulations. A <br />Permittee may appeal the revocation of a Permit in the manner provided in Section IX (Appeals) <br />hereof. The Permittee shall cause all of its Shared Mobile Devices to be removed from the City <br />within five (5) business days of notice of revocation of a Permit, regardless of whether or not <br />Permittee is appealing the revocation. The City may, at its discretion, remove any Shared Mobility <br />Devices that are not timely removed by Permittee. The City may dispose of any Shared Mobility <br />Devices that it removes in any manner authorized by law. The Permittee shall be responsible for <br />any and all costs incurred by the City for the removal or disposition of Shared Mobile Devices. <br />IX. Appeals <br />An Applicant whose application has been denied or a Permittee whose Permit has been revoked <br />or terminated may file an appeal with the City Manager by submitting a written statement to the <br />City Manager within 10 business days of the denial or revocation.
