at 346 Broad Street, Portsmouth, Virginia, Tax Parcel 0144 -0760, being more particularly <br />described as: <br />UP -19 -10 <br />346 Broad Street (Tax Parcel 0144 -0760) <br />ALL THOSE certain lots of land, with the buildings and <br />improvements thereon and the appurtenances thereunto belonging, <br />situate in the City of Portsmouth, Virginia, and known, numbered <br />and designated as Lots Six Hundred Eighty -seven (687), Six <br />Hundred Eighty -eight (688) and the adjoining one -half of Lot Six <br />Hundred Eighty -nine (689) as shown on the Map of Port Norfolk, <br />which said plat is duly recorded in the Clerk's Office of the Circuit <br />Court of the City of Chesapeake, Virginia, in Map Book 4, pages <br />70 and 71. <br />IT BEING the same property which was conveyed to Port Norfolk <br />Properties, L.C. by Deed of Bargain and Sale and Assumption <br />from William C. Creecy, Et Ux dated August 29, 1994 and <br />recorded in the Clerk's Office of the Portsmouth Circuit Court in <br />Deed Book 1138 at Page 1440. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The proposed micro - brewery shall be limited to 3,000 square feet in total <br />as shown on the proposed floor plans submitted with the Use Permit <br />application on record in the Department of Planning. <br />(b) The normal hours of public operation shall be limited to 1 1 A.M. to 11 <br />P.M. Monday through Thursday, 11 A.M. to Midnight on Friday and <br />Saturday, and 1 P.M. to 10 P.M. on Sunday. <br />(c) No live, amplified entertainment shall be conducted on the premises, <br />except that solo and duo artists may perform on the inside of the premises. <br />When music is played, all doors to the exterior shall remain closed (i.e. <br />shall not be propped open), particularly the overhead door on the north <br />side of the building. <br />(d) All operating licenses, approvals and permits required under federal, state <br />or local laws or regulations shall be obtained and kept current and in good <br />standing, and the micro - brewery shall operate in accordance with all <br />federal, state and local laws and regulations. <br />
