2. That Verizon Wireless is hereby granted a use permit pursuant to Section <br />40.1- 2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to construct and <br />operate a 150 -foot monopole telecommunications tower and equipment compound at 801 <br />Victory Boulevard, Portsmouth, Virginia, Tax Parcel 0449 -0010, being more particularly <br />described as: <br />UP -19 -07 <br />801 Victory Boulevard (Tax Parcel 0449 -0010) <br />ALL THAT certain lot, piece or parcel of land, with the <br />appurtenances thereto and the improvements thereon, lying, being <br />and situate in the City of Portsmouth, Virginia, and labeled as <br />"PARCEL 'I "' on that certain plat titled "Minor Subdivision of <br />Parcel `1' and Tax Parcels 04490022 & 04490010 /Portsmouth, <br />Virginia ", prepared by Hoggard /Eure Associates, P.C., dated July <br />14, 2014, and recorded in the Clerk's Office of the Circuit Court <br />for the City of Portsmouth, Virginia in Map Book 23 at Page 243. <br />The said parcel contains 386,042 Square Feet or 8.862 acres. <br />IT BEING all or a portion of that certain property conveyed by the <br />following deeds: (1) Deed from Johnnie L. Wood, Robert T. <br />Wood, Hazel L. McKone and Ella G. Beedle to Beach Marine <br />Properties, LLC dated August 29, 2004 and recorded in the <br />Portsmouth Circuit Court Clerk's Office as Instrument Number <br />040017559; (2) Deed from The Portsmouth Company to Beach <br />Marine Properties, LLC dated May 28, 2014 and recorded in the <br />Portsmouth Circuit Court Clerk's Office as Instrument Number <br />140005554, and (3) Deed from Office of Thrift Supervision, <br />Department of the Treasury, to Beach Marine Properties, LLC <br />dated August 29, 2004 and recorded in the Portsmouth Circuit <br />Court Clerk's Office as Instrument Number 070020977. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The proposed development shall be in substantial compliance with the <br />plans prepared by B C Architects Engineers with an Engineer's seal April <br />12, 2018 and submitted by the applicant, except where modifications may <br />be required to comply with the City's Ordinance requirements. <br />(b) The monopole telecommunications tower shall not exceed 150 feet in <br />height measured from the ground surface immediately adjacent to the <br />tower. <br />
