R -19 -09 <br />A RESOLUTION DECLARING A CERTAIN CITY -OWNED PROPERTY HAVING A <br />SIZE OF APPROXIMATELY FIVE HUNDREDTHS OF AN ACRE AND AN ADDRESS <br />OF 146 OWENS STREET (TAX PARCEL 0052 -0590) TO BE SUPLUS REAL <br />PROPERTY AND AUTHORIZING THE CONVEYANCE OF SAME TO BRANDON <br />ECIJAN. <br />WHEREAS, for many decades the City of Portsmouth has owned certain real property <br />having a size of approximately five hundredths of an acre and an address of 146 Owens Street <br />(Tax Parcel 0052 -0590) (the "Property "); and <br />WHEREAS, the Property is small and ill- suited for development as a standalone parcel; <br />and <br />WHEREAS, the City Assessor has assessed the value of the property at $590; and <br />WHEREAS, Brandon Ecijan, the owner of the only adjacent developed property (148 <br />Owens Street), has offered to purchase the Property for its assessed value; and <br />WHEREAS, as a pre- condition to the conveyance Mr. Ecijan has agreed to have a minor <br />subdivision plat prepared to vacate the lot line between the Property and Mr. Ecijan's property, <br />and at closing the City will reimburse the actual cost of preparation of the plat in an amount not <br />to exceed the available net sale proceeds; and <br />WHEREAS, the vacation of the lot line and merging of the Property and Mr. Ecijan's <br />property through recordation of a minor subdivision plat will ensure that no new house of a size <br />and quality incompatible with the neighborhood can be constructed on the Property; and <br />WHEREAS, the Property is surplus property, of no value or use to the City; and <br />WHEREAS, the proposed conveyance will place the Property back on the tax rolls and <br />result in additional tax revenues to the City; and <br />WHEREAS, in accordance with Section 15.2 -1800 of the Virginia Code a public hearing <br />has been held on the proposed conveyance; <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that: <br />1. That the Property is hereby declared to be surplus real property; <br />2. That conveyance of the Property to Brandon Ecijan for a purchase price of Five <br />Hundred Ninety Dollars ($590) is hereby approved and authorized; and <br />3. That the City Manager is authorized to execute deeds and other instruments, and <br />to take such further actions, as are necessary or desirable to complete the transaction authorized <br />by this Resolution. <br />
