UP -17 -12 2115 High Street (Tax Parcel 0171 -0160) ALL THAT certain lot, piece or parcel of land, lying, situate and being in the City of Portsmouth, Virginia, and being known, numbered and designated as Parcel B, as shown on that certain plat entitled, "Minor Resubdivision of Property of Westview Building Corporation, Located at #2111 & #2115 High Street, Portsmouth, Virginia ", dated June 19, 1990, prepared by Hoggard /Eure Associates as recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in Map Book 15, at page 43. BEING the property conveyed to Bountiful Blessings Day Care, LLC by Deed from GHH Loudoun High LLC dated August 1, 2016 and recorded in the Clerk's Office of the Portsmouth Circuit Court as Instrument Number 160007547. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Occupancy of the child day care center shall be limited to no more than fifty (50) children. The facility shall not provide care for infants (children under the age of 2 'h years). (b) The days and hours of operation for the child day care activities shall be limited to Monday through Friday no earlier than 6:00 a.m. and no later than 6:00 p.m. (c) Outdoor play shall be limited to Monday through Friday no earlier than 8:00 a.m. to no later than 6:00 p.m. The proposed outdoor play area shall comply with Portsmouth City Code Section 40.1- 4.3(B)(1)(iii). (d) The proposed parking area shall comply with Portsmouth City Code Section 40.1- 4.3(B)(1)(iv). The applicant shall maintain at least seventeen (17) off - street parking spaces for the drop- off /pick -up of children and staff parking. The spaces shall be configured so that children do not have to cross vehicular travelways to enter or exit the child day care center facility. Any reduction in parking spaces may result in a reduction in the number of children allowed.
