17. To contract for, purchase or otherwise procure insurance and investment <br />products. <br />B. Administrator. Pursuant to an administrative services agreement between the <br />Board of Trustees and the Administrator, the Administrator shall have the power and authority to <br />implement policy and procedural matters as directed by the Board of Trustees as they relate to <br />the ongoing operation and supervision of the Trust Fund and the provisions of this Agreement <br />and applicable law. <br />Section 104. TAXES. EXPENSES AND COMPENSATION OF TRUSTEES. <br />A. Taxes. The Administrator, without direction from the Board of Trustees, shall <br />pay out of the Trust Fund all tares, if any, imposed or levied with respect to the Trust Fund, or <br />any part thereof, under applicable law, and, in its discretion, may contest the validity or amount <br />of any tax, assessment, claim or demand respecting the Trust Fund or any part thereof. <br />B. Expenses and Compensation. The Board of Trustees is authorized to set aside <br />from Participating Employer contributions received and the investment income earned thereon a <br />reasonable sum for the operating expenses and administrative expenses of the Trust Fund. All <br />remaining funds coming into the Trust shall be set aside, managed and used only for the payment <br />of Other Post - Employment Benefits. <br />By resolution of the Board of Trustees, Trustees may be provided a reasonable per <br />diem fee and /or reimbursement for expenses for attendance at all meetings. Notwithstanding the <br />preceding sentence, any person employed by a public body, including elected officials or <br />appointed members of governing bodies of a county, city or town or other political subdivision, <br />shall not be eligible to receive fees for services as Trustee from the Trust Fund other than <br />reimbursement for reasonable expenses incurred in connection with his or her responsibilities as <br />a Trustee. <br />C. Payment of Expenses. The Board of Trustees may use and apply assets in the <br />Trust Fund to pay or provide for the payment of all reasonable and necessary expenses which <br />may be incurred in connection with the establishment and maintenance of the Trust Fund, <br />including but not limited to, the employment of such administrative, legal, accounting, and other <br />expert and clerical assistance, and the purchase or lease of such materials, supplies and <br />equipment as the Trustees, in its discretion, may deem necessary or appropriate in the <br />performance of its duties, or the duties of the agents or employees of the Trust Fund or the <br />Trustees. <br />Section 105. COMMUNICATIONS. <br />Until notice is given to the contrary, communication to the Trustees or to the <br />Administrator shall be sent to them at the Trust Fund's office in care of the Administrator.
