R -18 -33 <br />A RESOLUTION DIRECTING THAT AN ANALYSIS OF A PROPOSAL <br />RECEIVED FOR THE CONSTRUCTION OF A NEW CITY HALL AND A NEW <br />PUBLIC SAFETY BUILDING BE CONDUCTED BY CITY STAFF. <br />WHEREAS, in May 2018 the City received an unsolicited proposal for the <br />construction of a new City Hall and a new Public Safety Building; and <br />WHEREAS, the proposal was received in accordance with the Virginia Public - <br />Private Education and Infrastructure Act of 2002, as amended (Va. Code §§ 56.575 -1 <br />through 56.575 -18) (PPEA) and the Public - Private Infrastructure Act of 2002 - Guidelines <br />of the City of Portsmouth, revised December 2010 (the City Guidelines); and <br />WHEREAS, as required by the PPEA and the City Guidelines the City gave public <br />notice of the receipt of the proposal and provided the opportunity for other interested <br />parties to submit competing proposals; and <br />WHEREAS, the City received one additional proposal but the additional proposal <br />was subsequently withdrawn; and <br />WHEREAS, the City has requested that the initial offeror provide additional <br />detailed information for the purpose of analyzing the proposal; and <br />WHEREAS, the City Guidelines and § 56.575- 3(C)(1) of the PPEA provide that <br />City Council may direct City staff to perform the required analysis of the proposal prior to <br />any negotiation with the proposer and prior to any presentation of a draft comprehensive <br />agreement for Council approval; and <br />WHEREAS, given that the proposal addresses the development of the type of City <br />facilities which staff currently operates and with which staff is intimately familiar, staff <br />should perform the proposal review; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that, in accordance with the City Guidelines and § 56.575- 3(C)(1) of <br />the PPEA, City Council hereby directs that City staff should perform the required analysis <br />regarding the specifics, advantages, disadvantages, and long -term and short-term costs of <br />the proposal received for the construction of a new City Hall and a new Public Safety <br />Building. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on November 27, 2018. <br />Teste: <br />City Clerk <br />
