Sec. 30 -219. - Inclusion of service in the police or fire department of an annexed area. <br />Any continuous period of service with the police or fire department of a county or city from <br />which the city - annexed territory shall be included as creditable service; provided such employee <br />was: <br />(1) A paid full -time employee of such county or city police or fire department, <br />(2) A resident of the annexed territory, and <br />(3) Transferred directly from such county or city department between the time the final <br />annexation decree was entered and 60 days after the date the annexation became <br />effective; and, provided, further, that such employee contributes to the retirement <br />allowance account a sum equal to the amounts the in ividual would have contributed <br />had-4e the individual been a member of the system during the period for which <br />coverage is desired, anything in section 30 -156 to the contrary notwithstanding. Such <br />contributions shall be refundable in accordance with section 30 -242. <br />5. Section 30 -221 of the Code of the City of Portsmouth, Virginia (2006) is amended as <br />follows: <br />Sec. 30 -221. - Inclusion of service under the Virginia Retirement System. <br />With respect to any member who is employed full -time by the city at the time of making <br />application hereunder for service credits and who was a member of the former Virginia <br />Retirement System, currently the Virginia Retirement System, immediately prior toffs <br />becoming a member of this system, and whose membership in the Virginia Retirement System <br />has ceased through withdrawal offs t e individual's contributions thereunder, the period of <br />time during which the individual was a member of the Virginia Retirement System shall be <br />included as creditable service hereunder, provided -he lbe individual terminates membership <br />in said system and pays into the retirement system an actuarially determined amount deemed to <br />be correct and neutral by the retirement board with regard to funding the projected additional <br />retirement allowance to be received by the member through the purchase of such additional <br />service credit.
