EXHIBIT A <br />1. The definitions listed below contained in Section 30 -26 of the Code of the City of <br />Portsmouth, Virginia (2006) are amended as follows. The definitions in Section 30 -26 which are <br />not listed below are not hereby amended. <br />Sec. 30 -26. - Definitions. <br />As used in this article, unless otherwise required by the context, the following words and <br />terms shall have the meanings indicated: <br />Employee means any person regularly employed in the service of the city on a full -time <br />basis and whose compensation is wholly paid by the city, and persons holding offices <br />in the city required by the constitution of this state and their deputies, assistants and employees <br />employed on a full -time basis and whose compensation is paid partly by the city and partly by <br />the state, and members of the city council; but shall not include any person who is eligible for <br />membership in the Virginia Retirement System, the Portsmouth Fire and Police Retirement <br />System or who enters into an agreement with the city for inclusion in a deferred compensation <br />retirement plan which agreement specifically prohibits inclusion in other retirement systems <br />established by the city. An employee shall also be taken to mean any person employed under a <br />grant program who has been regularly employed in the service of the city on a full -time basis for <br />a period such that mmho will have become vested under the conditions as stated in section <br />30 -116, and whereby such grant program has participated in making the necessary contributions <br />to the system for the full period of the employee's service to be credited. <br />hall basis Effective duly 1.2011. <br />person _de to be rly emoloved on a full time j 'c! s, ed as such in the <br />Emolover's navroll system_,In case of doubt, the board shall decide who is an employee within <br />the meaning of this definition. <br />2. Section 30 -100 of the Code of the City of Portsmouth, Virginia (2006) is amended as <br />follows: <br />Sec. 30 -100. - Inclusion of service under the Virginia Retirement System. <br />With respect to any member who is employed full -time by the city at the time of making <br />application hereunder for service credits and who was a member of the former Virginia <br />Retirement System, currently the Virginia Retirement System, immediately prior toffs <br />becoming a member of this system, and whose membership in the Virginia Retirement System <br />has ceased through withdrawal of hisa the individual's contributions thereunder, the period of <br />A -1 <br />
