2 N .R� A <br />AN ORDINANCE TO ACCEPT A TRANSPORTATION ALTERNATIVES <br />PROGRAM GRANT IN THE AMOUNT OF $900,000 FROM THE VIRGINIA <br />DEPARTMENT OF TRANSPORTATION AND TO APPROPRIATE SAID <br />FUNDS TO THE RAIL TO TRAIL PROJECT TO BE ESTABLISHED IN THE <br />FY 2017 CAPITAL IMPROVEMENT PROGRAM BUDGET FOR THE <br />CONSTRUCTION OF A RAILS TO TRAILS PATHWAY. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That it hereby accepts a Transportation Alternatives Program grant in the <br />amount of $900,000 from the Virginia Department of Transportation and appropriates <br />said funds to the Rail to Trail Project to be established in the FY 2017 Capital <br />Improvement Program Budget. <br />2. That the funds shall be used by the Department of Engineering & <br />Technical Services for the construction of a Rails to Trails pathway for walking, running <br />and biking. <br />3. That the required local match in the amount of $225,000 has been satisfied <br />by Resolution R- 14 -40, adopted by City Council on November 25, 2014, which <br />committed previously appropriated funds in the Capital Improvement Program as the <br />match (subject to the substitution of abandoned Commonwealth Railway right of way to <br />be acquired by the City, as provided in Resolution R- 14 -40). <br />4. That the estimated amount of the State Categorical Aid revenue category <br />of the FY 2017 Capital Improvement Fund budget is increased by $900,000. <br />5. That the estimated revenue and expenditures in the Rail to Trail Project <br />line item to be established in the FY 2017 Capital Improvement Program Budget are <br />increased by $900,000. <br />6. That the City Manager is authorized to execute such agreements and other <br />instruments as are necessary to complete acquisition of the area of abandoned <br />Commonwealth Railway right of way which is necessary or desirable for construction of <br />the project. <br />7. That this ordinance shall take effect on the date of its adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on March 28, 2017. <br />Teste: <br />City Clerk <br />
