(a) The proposed use complies with the applicable standards of the <br />Ordinance; <br />(b) The proposed use is consistent with the comprehensive plan; <br />(c) The proposed use is compatible with the character of surrounding lands <br />and the uses permitted in the zoning district(s) of surrounding lands; <br />(d) The proposed use is configured to minimize adverse effects, including <br />the visual impacts of the proposed use on adjacent lands; <br />(e) The proposed use will directly or indirectly enhance the economic base <br />of the community; <br />(f) The proposed use avoids significant deterioration of water and air <br />resources, and other natural resources; <br />(g) The proposed use maintains safe and adequate egress and ingress onto <br />the site, and safe road conditions around the site; <br />(h) The proposed use allows for the protection of property values and the <br />ability of neighboring lands to develop the uses permitted in the zoning <br />districts; and <br />(i) The use complies with all other city, state, and federal laws and <br />regulations. <br />(5) Use Specific Special Exception Standards <br />(a) The $ZA may grant a special exception for a modification to the <br />number, form, or nature of the parking requirements contained in Section <br />40.1 -5.1 (Off - Street Parking, Loading, and Circulation) of this <br />Ordinance, provided: <br />(i) The applicant shall demonstrate that safe and convenient <br />pedestrian access is provided from the designated use to an off - <br />site parking facility or that transportation is available from an <br />off -site parking facility to the premises; <br />(ii) The applicant shall demonstrate that off -site parking spaces to <br />either supplement the on -site parking or meet the minimum <br />parking requirement, or a combination of both, are available on a <br />long -term basis of not less than twenty (20) years; <br />(iii) A parking modification which was granted based on an off -site <br />parking plan shall be void in the event that said off site parking <br />plan is terminated in whole or in part; <br />(iv) The applicant shall provide an adequate amount of parking to <br />accommodate the anticipated demand for parking generated by <br />the specified use; <br />(v) The authorization of parking modifications shall be limited to the <br />specified use or uses for which the special exception is <br />requested. Any enlargement of a building or change in use or <br />uses shall be subject to the parking requirement as specified in <br />this Ordinance or as otherwise approved for increase or <br />reduction as provided in this Ordinance; and <br />(vi) The applicant has demonstrated to the satisfaction of the City <br />Engineer that any off -site or on- street parking requested would <br />not have a negative impact on the surrounding neighborhood or <br />IM <br />
