The installation, placement, maintenance, or replacement of micro - wireless facilities <br />that are suspended on cables or lines that are strung between existing utility poles in <br />compliance with national safety codes is exempt from the application and permitting <br />requirements of this article. <br />Sec. 32 -309. — Relationship to right -of -way permit. <br />Nothing in this article shall be construed to waive the independent requirement to <br />obtain a right -of -way permit pursuant to Article II of Chapter 32 for any work involving <br />small cell facilities or micro - wireless facilities that by its nature triggers the permit <br />requirement set forth in section 32 -58. <br />Sec. 32 -310. — Applicability to co- location of small cell facilities on private property. <br />Applications for co- location of small cell facilities on existing structures located <br />on private property or otherwise outside the right -of -way shall comply with the <br />requirements of section 32 -304 except that such applications shall be submitted to, and <br />processed by, the zoning administrator. Except as provided in the foregoing sentence, the <br />provisions of this article XI apply only to applications for permits to co- locate small cell <br />facilities on existing structures within the right of way. Applications for co- location of <br />small cell facilities on existing structures located on private property or otherwise outside <br />the right -of -way shall be administered by the zoning administrator in accordance with the <br />requirements of state law and Chapter 40.1 of the city code. <br />
