Bangel by deed duly recorded in the Clerk's Office <br />aforesaid in Deed Book 307, at page 369, thence west and <br />parallel with High Street, 110 feet, more or less, to the east <br />side of Court Street; thence 68.1 feet more or less along the <br />east side of Court Street to its intersection with High Street, <br />the point of beginning. <br />IT BEING the same property conveyed to Progressive <br />Portsmouth, LLC by Deed of Contribution from Richard D. <br />Levin and Richard D. Ricks dated March 16, 2007 and <br />recorded in the Portsmouth Circuit Court Clerk's Office as <br />Instrument Number 070007032. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The number of dwelling units in the development shall not exceed 27. <br />(b) The applicant shall obtain approval for all exterior improvements, <br />including signage, from the Downtown Design Committee. <br />(c) The development shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local government, including, but not <br />limited to, the Virginia Uniform Statewide Building Code. In addition, the <br />applicant shall install an automatic fire sprinkler system, as required by the <br />City Building Official. <br />(d) All taxes fees associated with the property and or the proposed use shall <br />be paid when due. <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions <br />may serve as grounds for revocation of the use pen-nit by City Council. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on August 22, 2017. <br />Teste: <br />City Clerk <br />
