R -17 -11 <br />A RESOLUTION AUTHORIZING PARCEL RECONCILIATION FOR THE MARTIN <br />LUTHER KING FREEWAY EXTENSION PROJECT THROUGH THE CONVEYANCE <br />OF VARIOUS INTERESTS IN RIGHTS OF WAY AND OTHER RESIDUAL <br />PROPERTIES BETWEEN THE CITY OF PORTSMOUTH AND THE <br />COMMONWEALTH OF VIRGINIA. <br />WHEREAS, the Martin Luther King (MLK) Freeway Extension Project (0058- 965 -107, <br />RW101, UPC 76642) expanded the state -owned roadway between London Boulevard and I -264; <br />and <br />WHEREAS, the area of the MLK Extension includes several privately -owned parcels <br />which the Commonwealth of Virginia (acting through the Virginia Department of Transportation <br />(VDOT)) acquired, as well as several areas which were formerly City rights of way, including <br />without limitation portions of the former Harbor Drive, Trexler Avenue, and Bedford Street <br />(collectively, the "City Property Interests "); and <br />WHEREAS, the City has not yet formally conveyed the City Property Interests to <br />VDOT; and <br />WHEREAS, as part of its acquisitions for the MLK Extension VDOT acquired property <br />for new or relocated City rights of way necessitated by the project, including a portion of Trexler <br />Avenue and road sections for the connection of King Street and County Street, as well as certain <br />additional residual property (collectively, the "VDOT Property Interests ")• and <br />WHEREAS, VDOT has not yet conveyed the VDOT Property Interests to the City; and <br />WHEREAS, for purposes of clarity of title and responsibility it is advisable to perform a <br />parcel reconciliation for the MLK Extension Project through conveyance of the City Property <br />Interests to VDOT and conveyance of the VDOT Property Interests to the City; <br />NOW THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, <br />Virginia, that: <br />1. The City Manager is authorized to execute and deliver one or more Deed[s] <br />and /or other instruments or agreements which are necessary or desirable to convey the City <br />Property Interests to the Commonwealth of Virginia and /or VDOT. <br />2. The City Manager is authorized to accept and execute on behalf of the City one or <br />more Deed[s] and /or other instruments or agreements which are necessary or desirable to convey <br />the VDOT Property Interests to the City. <br />3. The conveyances authorized by this Resolution shall not be construed to close or <br />vacate any existing right of way. <br />4. This resolution shall take effect on the date of its adoption. <br />
