R -17 -07 <br />A RESOLUTION UNCONDITIONALLY AUTHORIZING THE CITY MANAGER TO <br />EXECUTE AND DELIVER A POST -2018 USE AND SUPPORT AGREEMENT WITH <br />THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY FOR THE USE AND <br />SUPPORT OF A REGIONAL SOLID WASTE DISPOSAL SYSTEM. <br />WHEREAS, the City of Portsmouth is a member of the Southeastern Public Service <br />Authority ( "SPSA "), existing under statutory authority and consisting of the Cities of <br />Chesapeake, Franklin, Norfolk, Portsmouth, Suffolk and Virginia Beach and the Counties of Isle <br />of Wight and Southampton ( "Member Localities "); and <br />WHEREAS, the Member Localities are parties to individual Use and Support <br />Agreements with SPSA providing for the disposal of municipal solid waste generated by or <br />collected in the SPSA service area; and <br />WHEREAS, all of the Use and Support Agreements that are currently operative will <br />expire on January 24, 2018; and <br />WHEREAS, the SPSA Board of Directors has approved the form of a Post -2018 Use <br />and Support Agreement to be entered into by all Member Localities to support the ongoing <br />operations of SPSA from and after January 25, 2018 ( "Post -2018 Agreement "); and <br />WHEREAS, on October 25, 2016 City Council adopted Resolution R- 16 -36, which <br />reaffirmed and adopted Resolution R- 16 -26, which itself had amended and restated Resolution <br />R -16 -18 (collectively, the "Prior Resolutions "); and <br />WHEREAS, the Prior Resolutions authorized the City Manager to execute a Post -2018 <br />Agreement, but expressly conditioned the authority upon the satisfaction of certain additional <br />terms and requirements; and <br />WHEREAS, City Council now desires to revoke the additional terms and requirements, <br />and to authorize the City Manager, unconditionally, to execute and deliver a Post -2018 <br />Agreement with SPSA; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it is the intent of the City to remain a member of SPSA and to execute a Post -2018 <br />Agreement. <br />BE IT FURTHER RESOLVED that the Prior Resolutions (Resolution R- 16 -18, <br />Resolution R- 16 -26, and Resolution R- 16 -36) are hereby revoked and shall be null, void and of <br />no further force or effect. <br />BE IT FURTHER RESOLVED that the City Manager be, and she hereby is, <br />unconditionally authorized to execute and deliver on behalf of the City a Post -2018 Agreement <br />with SPSA. <br />
