any employee hired or (rehired) on or after December 1, 1984 be included as a member. In <br />addition, any retiree of the Portsmouth Supplemental Retirement Svstem~ who as of <br />November 30, 1984, is employed by an employer who participates in the Virginia Retirement <br />System VRS shall be transferred to thatt retirement system for the purpose of payments of <br />pensions. No city council member whose first term of office commences after December 1 <br />2016 shall aualifv for membership in the Portsmouth Supplemental Retirement System by virtue <br />of his or her service on city council. <br />10. Section 30-97 of the Code of the City of Portsmouth, Virginia (2006) is hereby amended <br />as follows. <br />Sec. 30-97. - Effecti~ of cessation of membership. <br />When membership ceases, an employee shall thereafter lose all right to any retirement <br />allowance or benefits under this article arising from service prior to the date of cessation of <br />membership; except as hereinafter provided. Forfeitures shall not be applied to increase the <br />benefits of any member. Funds freed through forfeitures that arise for any reason shall only hP <br />used to reduce employer contribution and to nay reasonable administrative expenses of the <br />ss s <br />11. Subsection 30-131(a) of the Code of the City of Portsmouth, Virginia (2006) is hereby <br />amended as follows. Subsections 30-131(b) and (c) are not hereby amended. <br />Sec. 30-131. -Reduction of disability retirement allowance. <br />(a) Whenever a member receiving a disability retirement allowance subsequently becomes <br />engaged in gainful occupation, the disability allowance shall be reduced by the amount of <br />income received which exceeds the difference between the disability retirement allowance <br />and the amount of wages or salary the member would have been entitled to had his <br />employment progressed in the same ramie and grade with credit for the level of <br />seniority he would have attained had he not been disabled. Such reduction in disability <br />retirement allowance shall continue until his retirement date. <br />12.
