~^~~:. <br />~`~~,~~tt~x pv~'_€~2~.1.87, <br />AN ORDINANCE TO AMEND CHAPTERS 9 (CITY CEMETERIES) AND 25 <br />(GENERAL PARK REGULATIONS) OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTION 9-56 AND <br />SECTION 25-108 PERTAINING TO THE PRESENCE OF DOGS IN <br />CEMETERIES AND PARKS. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Article II of Chapter 9 of the Code of the City of Portsmouth, <br />Virginia (2006) (City Cemeteries) be amended and reordained by amending Section 9-56 <br />to read as follows: <br />Sec. 9-56. -Dogs prohibited: a cent as provided herein. <br />No person shall permit a dog to go into any city cemetery excent:= <br />(11 An individual who is on the cemetery property for the purnose of visiting a <br />gravesite. attending a burial. or another similar puraose maybe accompanied <br />by a guide dog, service dog or other dog accorded special status under federal <br />or state disability or accommodation laws or regulations: and <br />(21 The city manager or the city manager's designee may authorize the presence <br />of specially trained dogs on the cemetery property for property maintenance <br />activities conducted by or at the direction. of the city. provided that all such <br />activities shall be performed in compliance with all applicable state and <br />federal laws. <br />2. That Article III of Chapter 25 of the Code of the City of Portsmouth, <br />Virginia (2006) .(Parks and Recreation) be amended and reordained by amending Section <br />25-108 to read as follows: <br />Sec. 25-108. -Animals at large. <br />No person shall cause or permit any animal owned by him, in his custody, or <br />under his control, to go at large within any park unless held in leash by a responsible <br />person, and such leash shall not exceed seven feet in length. Any person who shall <br />violate the provisions of this section shall be guilty of a class 4 misdemeanor. <br />Notwithstanding the foregoing. the restrictions established by this section shall not apply <br />in the following circumstances: <br />(11 Unleashed dogs shall be permitted in designated fenced areas within a park <br />which have been expressly established by the city manager or the city <br />manager's designee as areas where leashes are not required: and <br />(21 The city manager or the city manager's designee may authorize the presence <br />of unleashed specially trained dogs on the park property for property <br />
