38. Anew section, designated Section 12-287, is added to the Code of the City of <br />Portsmouth, Virginia (2006) as follows: <br />Sec 12-287 -Purchase of building material etc from architect or en ineer <br />prohibited. <br />(al No building materials. supplies or eauipment for anv buildinc or structure <br />constructed by or for a public bodv shall be sold or purchased from anv person <br />employed as an indenendent_contractor bvthe public bodv to furnish architectural or <br />en ineerin~ services. but not construction. for such building or structure or from anv <br />partnership, association or cornoration in which such architect or eneineer has a <br />personal interest as defined in Code of Virginia & 2 2-3101 as amended restated or <br />moved from time to time. <br />(bl No building materials. supplies or eauipment for anv building or structure <br />constructed by or for a public bodv shall be sold by or purchased from anv person <br />who has provided or is currently providing design services snecifyin~ a sole source <br />for such materials. supplies or eauipment to be used in the building or structure to <br />the independent contractor employed by the Public bodv to furnish architectural or <br />en ineerin~ services in which such person has a personal interest as defined in Code <br />~VZYglnla. & 2.2-3101. as amended. restated or moved from time to time <br />39. Anew section, designated Section 12-288, is added to the Code of the City of <br />Portsmouth, Virginia (2006) as follows: <br />Sec 12-288 -Certification of compliance reauired• penalty for false statements <br />(al Public bodies may require public employees having official responsibility for <br />procurement transactions in which they participated to annually submit for such <br />transactions a written certification that they complied with the provisions of this <br />Division. <br />(bl Anv public employee reauired to submit a certification as provided in subsection (al <br />who knowingly makes a false statement in the certification shall be punished as <br />provided in Code of Virginia. & 2.2-4377. as amended, restated or moved from time <br />to time. <br />40.
