(~) , <br />. Unsuccessful bidders shall be entitled to <br />return of surety when the purchasing administrator has required such. A successful <br />bidder shall forfeit any surety required by the purchasing administrator upon failure <br />on his part to enter a contract within ten days after the award. <br />21. Section 12-247 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />as follows: <br />Sec. 12-247. -Security in lieu of bid bond. <br />(a) In lieu of a bid bond, a bidder may furnish a certified check, cashier's check or cash <br />escrow in the face amount required for the bond. <br />(b) If approved by the city attorney, a bidder may furnish a personal bond, property <br />bond, or bank or savings and loan institution ~~letter of credit on certain <br />designated funds in the face amount required for the bid bond. Approval shall be <br />granted only upon a determination that the alternative form of security proffered <br />affords protection to the city equivalent to the corporate surety bond. <br />22. Section 12-249 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />as follows: <br />Sec. 12-249. -Submission and opening of bids. <br />All bids shall be submitted in sealed envelopes addressed to the purchasing <br />administrator and shall be identified as bids on the envelope. Bids shall be opened <br />publicly at the time and place designated in the invitation to bid. The amount of each bid, <br />and such other relevant information as the purchasing administrator deems appropriate, <br />together with the name of each bidder shall be recorded and made public.; ~'-~ --~~~---' ~~a <br />23. Subsections (a) and (b) of Section 12-250 of the Code of the City of Portsmouth, <br />Virginia (2006) are amended as follows: <br />Sec. 12-250. -Withdrawal of bid due to error. <br />(a) A bidder for a public construction contract, other than a contract for construction or <br />maintenance of public highways, may withdraw his bid from consideration if the <br />price bid was substantially lower than the other bids due solely to a mist <br />therein, provided the bid was submitted in good faith, and the mistake was a clerical <br />mistake as opposed to a judgment mistake, and was actually due to an unintentional <br />arithmetic error or an unintentional omission of a quantity of work, labor or material <br />17 <br />
