UPTOWN D2 DISTRICT FORM-BASED CODE January 26, 2016 <br />Part 1. General Provisions <br />101. Title <br />This Code is known as the Uptown D2 District Form-Based Code. <br />102. Purposes <br />A. The City of Portsmouth Comprehensive Plan Destination 2025 (adopted April 29, 2005) identifies <br />High Street as a FOCUS (Fulfilling Our Comprehensive Urban Strategy) Revitalization Corridor <br />between Effingham and Airline Boulevard. This Code is intended to meet the goals of the <br />Comprehensive Plan by providing strong implementation tools for this area. <br />B. The Code is designed to foster a setting for economic growth and development in a <br />sustainable mixed-use pattern of diverse urban neighborhoods, integrating RESIDENTIAL with <br />employment and commercial uses (as well as recreational opportunities), within the Uptown <br />D2 District. <br />C. The Code shall be applied to new, infill development, and re-development in the designated <br />locations both in order to achieve the vision set forth for the Uptown D2 District and to provide <br />a mechanism for implementing the following specific goals, using both public and private <br />sector investment: <br />1. Capitalize on public investment in existing infrastructure <br />2. Promote compact, mixed-use development at moderate to high densities <br />3. Ensure transit-supportive and transit-serviceable development <br />4. Require pedestrian-oriented and transit-oriented design <br />5. Ensure compatibility with surrounding neighborhoods <br />D. The creation of transit- and pedestrian-oriented development is dependent on three factors: <br />density, diversity of uses, and design. The Code places greatest emphasis on the third element <br />(design, or physical form) because it is of greatest importance when creating the places that <br />attract jobs and economic vitality. Density and uses can be expected to change over time as <br />the district grows and matures. <br />103. Application <br />This Code is applicable to the Uptown D2 District as shown on the official Zoning Map and the <br />UptOWn D2 DIStrICt REGULATING PLAN. <br />104. Relationship to Zoning Ordinance <br />This Code is an Appendix to and a part of the Zoning Ordinance (Article 40.1-1, et seq. of the City <br />Code). Except -where expressly provided otherwise, the provisions of general applicability ih the <br />other portions of the Zoning Ordinance apply to the Uptown D2 District. Provided however, that <br />any provision of this Code that conflicts with another provision of the Zoning Ordinance shall be <br />deemed to control within the Uptown D2 District to the extent of such conflict. <br />105. Severability <br />Should any provision of this Code be decided by the courts to be unconstitutional or invalid, that <br />decision shall not affect ..the validity of the Code other than the part decided to be <br />unconstitutional or invalid. <br />
