EXHIBIT A <br />1. Section 12-173 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />in pertinent part as follows: <br />Sec. 12-173. -Definitions. <br />The following words, terms and phrases, when used in this article, shall have the <br />meanings ascribed to them in this section, except where the context clearly indicates a <br />different meaning: <br />Business means any corporation, partnership, = limited liability company. <br />association, or sole proprietorship operated for profit, ' , ' <br />or any other private legal entity. <br />^ Y~ > > <br />Invitation for bids means all documents, whether attached or incorporated by <br />reference, utilized for soliciting sealed bids. <br />Job order contracting means a method of~rocuring construction services by <br />establishing a book of un_ it prices and then obtaining a contractor to perform work as <br />needed using the prices quantities and specifications in the book as the basis of its <br />pricing. The contractor maybe selected through either competitive sealed bidding or <br />competitive negotiation depending on the needs of the city A minimum amount of work <br />maybe sbecified in the contract. The contract term and the proiect amount shall not <br />exceed the limitations specified in Code of Virginia && 2 2 4302 2 or 2 2 4303 as <br />amended. restated_or moved from time to time <br />Life cycle costing means an evaluation that takes into account all costs incidental to <br />the planning, design, construction, operation, maintenance, and disposal of a system or <br />facility calculated in terms of present value or annual owning and operating costs. <br />Professional services means work performed by an independent contractor within <br />the scope of the practice of accounting, actuarial services, architecture, land surveying, <br />landscape architecture, law, dentistry, medicine, optometry, pharmacy, or professional <br />engineering. <br />
