~~ r,~' <br />AN ORDINANCE TO AMEND ARTICLE V OF CHAPTER 12 OF THE CODE <br />OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) PERTAINING TO <br />PUBLIC PROCUREMENT FOR THE PURPOSES OF MAINTAINING <br />CONSISTENCY WITH THE CODE OF VIRGINIA AND ADDING OR <br />MODIFYING CERTAIN ADDITIONAL PROVISIONS. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Article V of Chapter 12 of the Code of the City of Portsmouth, <br />Virginia (2006) be amended and reordained as shown on Exhibit A hereto, which is made <br />apart hereof. The amendments shown on Exhibit A include: <br />(a) amending the following existing Code sections: Section 12-173 (Definitions), <br />Section 12-174 (Establishment of purchasing system; designation of purchasing <br />administrator), Section 12-175 (General powers and duties of purchasing <br />administrator), Section 12-176 (Program to facilitate participation in procurement <br />transactions by small businesses and businesses owned by women and <br />minorities), Section 12-177 (Cooperative procurement), Section 12-180 (Contract <br />pricing arrangement), Section 12-184 (Performance and payment bonds <br />generally), Section 12-186 (Public access to procurement information), Section <br />12-187 (Prompt payment by city; notice of defects; late payment charges), Section <br />12-212 (Requirements for certain state-aid construction contracts), Section 12-214 <br />(Cancellation or rejection of invitations and other solicitations and bids and <br />proposals), Section 12-215 (Exemptions from requirements of competitive <br />bidding or competitive negotiations -Generally), Section 12-217 (Same - <br />Purchases at public auction), Section 12-220 (Same -Small purchases), Section <br />12-241 (Notice of invitation to bid; soliciting bids), Section 12-245 (Bid bonds <br />generally -Construction contracts), Section 12-246 (Same -Other contracts), <br />Section 12-247 (Security in lieu of a bid bond), Section 12-249 (Submission and <br />opening of bids), Section 12-250 (Withdrawal of bid due to error), Section 12-252 <br />(Bid award generally), Section 12-255 (Actions on payment bonds; waiver of <br />right to sue), Section 12-276 (Negotiation for other than professional services <br />generally), Section 12-277 (Negotiation for insurance), Section 12-278 <br />(Negotiation for professional services), Section 12-280 (Applicability of state <br />ethics in public contracting law), Section 12-290 (Procedures established), <br />Section 12-291 (Debarment authorized), and Section 12-293 (Procedures for <br />debarment); <br />(b) moving and renumbering the following existing Code sections: Section 12-290 <br />(Procedures established), Section 12-291 (Debarment authorized), Section 12-292 <br />(Causes for debarment), Section 12-293 (Procedures for debarment), Section 12- <br />294 (Appeals), and Section 12-295 (Bonds and indemnification); and <br />(c) adopting the following new Code sections: Section 12-221 (Same - <br />Construction), 12-222 (Design-build or construction management contracts; <br />eligibility requirements; award of contract), Section 12-223 (Job order <br />
