Vending means the sale of food and/or nonalcoholic beverages from a food or ice <br />cream truck on any public street or sidewalk. <br />Vendor means any person, including an employee or agent of another, engaged in <br />vending on any public street or sidewalk.. <br />Sec. 32-277. -Violations of article. <br />(a) Any person violating any provision of this article shall be guilty of a class 2 <br />misdemeanor. <br />(b) The placement of any vending unit or other type of device related to the operation of <br />a food truck or ice cream truck on any sidewalk in violation of the provisions of this <br />article is declared to be a public nuisance detrimental to the health, safety, and <br />welfare of the residents of the city. <br />(c) Operating a food truck outside of authorized areas, without the possession of all <br />required permits, and/or without any required consent from the city or private <br />property owners shall be considered a violation of this article and may result in <br />suspension from the food truck program and/or the revocation of the vendor's <br />business license. <br />Sec. 32-278. -Hours of operation. <br />No vendor shall operate except between the hours of 7:00 a.m. and 9:00 p.m. All <br />mobile vending units must be removed from public property, designated parking <br />locations, or approved vending locations during non-operating hours. Hours of operation <br />may be extended by the city manager or the city manager's designee for special events. <br />Sec. 32-279. -Signs restricted. <br />(a) All signs must be firmly attached at all points to the food or ice cream truck. No <br />sign may protrude off of the vehicle or extend off of the vehicle such that any <br />portion of the rear of the sign is visible. <br />(b) Flags, banners, portable signs such as A-frames, or other decorative appurtenances, <br />whether attached or detached, are prohibited. <br />Sec. 32-280. -Noise restricted. <br />(a) Food and ice cream trucks, including those operating with a generator, are subject to <br />the prohibitions on excessive sound established in Section 24-255 (as the same may <br />be amended, moved, or superseded from time to time). Generators shall not operate <br />at decibel levels above the lesser of the limitations set forth in Section 24-255(d) (as <br />the same may be amended, moved or superseded from time to time) or the following <br />limitations: <br />(1) Residential zones; night. In a residential zone between 10:00 p.m. and <br />6:00 a.m., sound meeting or exceeding 55 dBA. <br />(2) Residential zones; day. In a residential zone between 6:00 a.m. and 10:00 <br />p.m., sound meeting or exceeding 65 dBA. <br />(3) Commercial zones. In a commercial zone, sound meeting or exceeding 75 <br />dBA. <br />2 <br />
