~ ~~ ~ ~~~~ 2015-07 <br />~. <br />AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) BY AMENDING SECTIONS 23-27 AND 23-28 <br />THEREOF PERTAINING TO CITY ISSUANCE OF A NOTICE TO ABATE <br />HIGH GRASS AND WEEDS. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Sections 23-27(a) and 23-28 of the Code of the City of Portsmouth, <br />Virginia (2006) are amended to read as follows: <br />Sec. 23-27. Notice to abate-Required; contents. <br />(a) Whenever the director or his/her designee finds that grass or weeds exist <br />on any land, alley, sidewalk or street, he shall give notice in writing of the existence of <br />the nuisance to the owner or occupant, or both, or lienholder, of the land on which the <br />nuisance exists, or to the owner or occupant, or both, or lienholder, of the land abutting <br />the alley, sidewalk, or street on which the nuisance exists, and shall order the owner or <br />occupant, or both, to cut and, when necessary, remove the grass or weeds within such <br />reasonable time as the director or designee shall specify in the notice; provided, that in no <br />event shall the time allowed be greater than ten days. Two notices issued during a <br />calendar year shall constitute reasonable notice for the calendar year, and no additional <br />notices shall be required. The notice shall provide that, if the grass or weeds are not cut, <br />and/or removed from such land or premises and maintained in accord with this section, <br />the same shall be done by the city or its agent, at the expense of the owner. <br />Sec.23-28. Same-Service. <br />Except as otherwise provided in section 23-27, service of the notice required to be <br />given under section 23-27 shall be made by mailing the notice to the last known street or <br />post office address of the person or lienholder to whom it is directed or by delivery <br />thereof to such person or lienholder and simultaneously posting the notice on the land or <br />premises on which the nuisance exists or on the land or premises abutting the sidewalk1 <br />street, or alley on which the nuisance exists. Proof of so mailing or delivering a notice or <br />the posting of such notice shall be sufficient evidence that the notice was served and the <br />date of mailing or delivery or posting, as the case may be, shall be the date of service. <br />2. That this ordinance shall take effect on the date of its adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on February 10, 2015. <br />Teste: <br />City Clerk <br />
