Portsmouth, Virginia, Code of Ordinances; PART !i -CODE -Chapter 14.7 FLOOD PROTECTION Management Agency (FEMA} and dated August 3, 2015 or any subsequent revisions or amendments thereto or (b} otherwise deemed special flood hazard areas pursuant to the provisions of this chapter. Sec. 14.1-3. - Compliance and liability. (a} No land shall hereafter be developed and no structure shall be located, relocated, constructed, reconstructed, enlarged or structurally altered excep# in full compliance with the terms and provisions of this chapter and any other applicable ordinances and regulations which apply to uses within the jurisdiction of this chapter. (b} The degree of flood protection sought by the provisions of this chapter is considered reasonable far regulatory purposes and is based an acceptable engineering methods of study, but does not imply total flood protection. Larger floods may occur on rare occasions. Flood heights may be increased by manmade or natural causes, such as excessive rainfall, ice jams, and bridge openings restricted by debris. This chapter does not imply that districts outside the floodplain district or that land use within such district will be free from flooding or flood damages. (c} The provisions of this chapter shall not impose liability on the City of Portsmouth or any officer ar employee thereof for any flood damages that result from reliance an this chapter or any administrative decision made hereunder. Sec.14.1~. -Penalties. (a} Any person who fails to comply with any of the requirements or provisions of this chapter or any order of the Floodplain Administrator ar his designee, ar any authorized employee shall be guilty of the appropriate violation and subject to the penalties therefore. Any person who fails to comply with any of the requirements or provisions of this chapter or any order of the Floodplain Adminis#rator or his designee ar any other authorized empioyee shall be guilty of a class 1 misdemeanor. {b} In addition to the above penalties, all other actions are hereby reserved, including an action seeking equitable relief for the proper enforcement of this chapter by the Floodplain Administrator or his designee or other authorized employee. The imposition of a fine or penalty for any violation af, or noncompliance with, the provisions of this chapter shall not excuse the violation or noncompliance so as to permit it to continue, and all violations shall be corrected ar remedied within a reasonable time, Any structure constructed, reconstructed, enlarged, altered, or relocated in noncompliance of this chapter may be declared by the City of Portsmouth to be a public nuisance and abatable as such. Flood insurance and/or certificates of occupancy may be withheld from structures constructed in viola#ion of this chapter. Sec. 14.1-5. -Specific definitions. The following words, terms and phrases, when used in this chapter, steal! have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Appurtenant ar accessory structure means an accessory structure not to exceed 200 sq. ft. 2
