Portsmouth, Virginia, Code of Ordinances; PART !i -CODE -Chapter 14.7 FLOOD PROTECTION <br />Management Agency (FEMA} and dated August 3, 2015 or any subsequent revisions or amendments <br />thereto or (b} otherwise deemed special flood hazard areas pursuant to the provisions of this chapter. <br />Sec. 14.1-3. - Compliance and liability. <br />(a} No land shall hereafter be developed and no structure shall be located, relocated, constructed, <br />reconstructed, enlarged or structurally altered excep# in full compliance with the terms and provisions <br />of this chapter and any other applicable ordinances and regulations which apply to uses within the <br />jurisdiction of this chapter. <br />(b} The degree of flood protection sought by the provisions of this chapter is considered reasonable far <br />regulatory purposes and is based an acceptable engineering methods of study, but does not imply <br />total flood protection. Larger floods may occur on rare occasions. Flood heights may be increased by <br />manmade or natural causes, such as excessive rainfall, ice jams, and bridge openings restricted by <br />debris. This chapter does not imply that districts outside the floodplain district or that land use within <br />such district will be free from flooding or flood damages. <br />(c} The provisions of this chapter shall not impose liability on the City of Portsmouth or any officer ar <br />employee thereof for any flood damages that result from reliance an this chapter or any administrative <br />decision made hereunder. <br />Sec.14.1~. -Penalties. <br />(a} Any person who fails to comply with any of the requirements or provisions of this chapter or any order <br />of the Floodplain Administrator ar his designee, ar any authorized employee shall be guilty of the <br />appropriate violation and subject to the penalties therefore. Any person who fails to comply with any <br />of the requirements or provisions of this chapter or any order of the Floodplain Adminis#rator or his <br />designee ar any other authorized empioyee shall be guilty of a class 1 misdemeanor. <br />{b} In addition to the above penalties, all other actions are hereby reserved, including an action seeking <br />equitable relief for the proper enforcement of this chapter by the Floodplain Administrator or his <br />designee or other authorized employee. The imposition of a fine or penalty for any violation af, or <br />noncompliance with, the provisions of this chapter shall not excuse the violation or noncompliance so <br />as to permit it to continue, and all violations shall be corrected ar remedied within a reasonable time, <br />Any structure constructed, reconstructed, enlarged, altered, or relocated in noncompliance of this <br />chapter may be declared by the City of Portsmouth to be a public nuisance and abatable as such. <br />Flood insurance and/or certificates of occupancy may be withheld from structures constructed in <br />viola#ion of this chapter. <br />Sec. 14.1-5. -Specific definitions. <br />The following words, terms and phrases, when used in this chapter, steal! have the meanings ascribed <br />to them in this section, except where the context clearly indicates a different meaning: <br />Appurtenant ar accessory structure means an accessory structure not to exceed 200 sq. ft. <br />2 <br />
