(3) an application in the form required by the commissioner of the revenue
and specifically identifying the motor vehicle for which an exemption is
sought.
(d) An eligible disabled veteran may have no more than one motor vehicle exempted
from taxation pursuant to this section. All other motor vehicles owned or
regularly used by said eligible disabled veteran shall be taxed or levied pursuant
to the general tax rate established by city council on motor vehicles.
(e) If an eligible disabled veteran seeks to change the motor vehicle subject to the
exemption, the veteran must first submit an application to the commissioner of the
revenue identifying the new vehicle. The exemption established by this section
shall not automatically transfer or retroactively apply to a new motor vehicle
acquired by an eligible disabled veteran. If an eligible disabled veteran transfers
the exemption from one motor vehicle to another but maintains ownership of the
first motor vehicle, the exemption shall continue to apply to the original motor
vehicle for the tax year of the transfer and shall not apply to the new vehicle until
the next tax year.
(f) The exemption established by this section shall not continue with a motor vehicle
upon transfer, sale or other disposition of the vehicle by an eligible disabled
veteran.
(g) The exemption established by this section shall first take effect for the calendar
year in which an eligible disabled veteran submits an application meeting the
requirements of subsection (c) for a qualified motor vehicle. The exemption shall
not be applied retroactively to previous years' tax filings.
2. That this ordinance shall take effect on January 1, 2016.
ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held
on June 23, 2015.
Teste:
City Clerk
