2. That Operation Restore Dreams is hereby granted a use permit pursuant to <br />Section 40.1-2.3(B) of the Code of the City of Portsmouth, Virginia (2006) to operate a <br />child day care center at 450 Dinwiddie Street, and being more particularly described as: <br />UP-15-O1 <br />450 Dinwiddie Street <br />(Tax Parce10012-0930) <br />BEGINNING at the southwest corner of Queen Street and <br />Dinwiddie Street; thence in a westerly direction approximately <br />245' to a point; thence in a southerly direction approximately 110'; <br />thence in an easterly direction approximately 234' to the western <br />line of Dinwiddie Street; thence in a northerly direction <br />approximately 110' along the western line of Dinwiddie Street to <br />the point of beginning. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The days and hours of operation for the child day care activities shall be <br />Monday through Friday and operated no earlier than 5:00 a.m. and no later <br />than 8:30 p.m. <br />(b) The applicant shall receive a written determination of compliance from the <br />City's Building Official that confirms that the necessary building <br />alterations and/or modifications are permitted, approved and completed <br />prior to the initiation of the use. The City's Building Official has <br />interpreted that the proposed use represents a change of occupancy to an I- <br />4child care facility, as defined by the 2012 Virginia Construction Code <br />(Part I of the Virginia Uniform Statewide Building Code -Effective July <br />14, 2014). <br />(c) The child day care center shall be limited to an occupancy of twenty (20) <br />children based upon the requirements outlined in Portsmouth City Code <br />Section 40.1-4.3(B)(1)(a)(iv), which requires that drop off/pick up spaces <br />for children are configured so that a child will not cross a vehicular <br />travelway. The existing curbside loading zone provides space for two (2) <br />vehicles. <br />(d) The child day care center shall provide eight (8) off-street parking spaces, <br />as required by Portsmouth City Code Section 40.1-5.1(E), within the <br />church parking lot fronting Queen Street. <br />(e) The facility shall be operated in compliance with applicable codes, <br />ordinances and regulations of federal, state and local government and all <br />
