UP-14-11 1028 Blair Street ALL THAT certain lot, piece or parcel of land with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in the City of Portsmouth, Virginia and bounded and described as follows, to-wit: Beginning at a point on the north side of Blair Street (formerly B Street) 197 feet west from the northwest intersection of Hatton Street and Blair Street (formerly B Street) and from said point of beginning running thence west along the north side of Blair Street (formerly B Street) 56 feet; thence north and parallel with Hatton Street 116 feet; thence east and parallel with Blair Street (formerly B Street) 56 feet; and thence south and parallel with Hatton Street 116 feet to the point of beginning. BEING all that property conveyed to Richelle Scott by Deed of Bargain and Sale from Fred Alston, Sr. dated August 24, 2005 and recorded in the Portsmouth Circuit Court Clerk's Office as Instrument Number 050017762. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Days and hours of operation shall be limited to Monday through Friday, between 5:00 a.m. and 8:30 p.m. (b) The applicant shall maintain three of the four driveway spaces for the child day care activity during hours of operation. (c) The facility shall be operated in compliance with applicable codes, ordinances and regulations of federal, state and local government and all required licenses and permits shall be obtained and remain in effect during the operation of the Child Day Care Center. (d) All taxes/fees associated with the property and the use shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by City Council.
