convenience store with gasoline sales at 3500 Victory Boulevard, Portsmouth, Virginia, <br />and being more particularly described as: <br />UP-14-14 <br />3500 Victory Boulevard <br />ALL THAT certain parcel of land with the buildings <br />and improvements thereon, lying, situate and being <br />in the City of Portsmouth, State of Virginia, and <br />more particularly bounded and described as follows: <br />BEGINNING at a point. in the westerly right of way <br />line of Greenwood Drive at its intersection with <br />Victory Boulevard and running N 24 degrees 32' S9" <br />W along the northerly right of way line of Victory <br />Boulevard a distance of 175 feet to a point; <br />THENCE, running N 64 degrees 5' 20" E a distance <br />of 150 feet to a point; THENCE, running S 24 <br />degrees 32' 43" E a distance of 175 feet to a point in <br />the westerly right of way of Greenwood Drive; <br />THENCE running in a southwesterly direction along <br />the westerly right of way line of Greenwood Drive a <br />distance of 150 feet to the point of beginning. <br />BEING the same property conveyed to Nine - T-9, <br />L.L.C. by Deed of Gift from Sun K. Smith f/k/a Sun <br />K. Ward dated March 6, 2002 and recorded in the <br />Portsmouth Circuit Court Clerk's Office as <br />Instrument Number 022383. <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development of the site shall be in substantial conformity with the <br />concept plan titled Victory & Greenwood Concept Plan for 7-Eleven <br />prepared by Blakeway Corp. and dated August 18, 2014 and the <br />Perspective and Fueling Canopy Elevations prepared by K2M Design <br />dated June 18, 2014, except as may be necessary to comply with any <br />modifications required by City Ordinances and the City .Code during site <br />plan review and approval. <br />(b) The applicant must obtain and keep current any required operating <br />licenses and shall operate in accordance with all applicable codes, <br />ordinances, and regulations of federal, state and local governments. <br />
