R-14-20 A RESOLUTION AUTHORIZING THE DEPARTMENT OF PUBLIC UTILITIES TO APPROVE CHANGE ORDERS TOTALING MORE THAN 25% OF THE CONSTRUCTION CONTRACT WITH GASTON BROTHERS UTILITIES, LLC FOR QUADRANT 1 OF THE DOWNTOWN MASTER UTILITY PLAN WATER AND SEWER REHABILITATION PROJECT. WHEREAS, a project budget of $11,500,000 was originally projected by the City's Design Engineer for Quadrant l of the Downtown Master Utility Plan Water and Sewer Rehabilitation Project; and WHEREAS, a construction contract in the amount of $9,867,599 for replacement of water and sanitary sewer lines and rehabilitation/replacement of storm sewer within a 16-block area of Downtown Portsmouth was awarded to Gaston Brothers Utilities, LLC, in January 2013; and WHEREAS, significant changes in project scope and cost increases due to unknown field conditions, including the replacement of a 16-inch waterline and storm sewers and the restoration of brick sidewalks, have resulted in additional construction costs that will exceed 25% of the original contract amount; and WHEREAS, Section 12-183 of the City Code requires Council approval to exceed an original contract amount by more than 25% or $50,000, whichever is greater; and WHEREAS, while it is projected that the final project cost will be $13,821,417, funding for the additional project costs is available in the Public Utilities Capital Improvements budget. NOW THEREFORE BE IT RESOLVED -by the Council of the City of Portsmouth, Virginia that, pursuant to Section 12-183 of the City Code, the Director of Public Utilities is authorized to expend the additional funds necessary to complete the Quadrant 1 of the Downtown Master Utility Plan Water and Sewer Rehabilitation Project within the budget projected above.
