R-14-08 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF PORTSMOUTH AND THE HAMPTON ROADS PLANNING DISTRICT COMMISSION FOR A REGIONAL WATER QUALITY MONITORING PROGRAM TO SATISFY THE REQUIREMENTS OF FEDERAL AND STATE LAW AND REDUCE WATER POLLUTION IN THE CHESAPEAKE BAY AND ITS TRIBUTARIES. WHEREAS, federal and state laws require the development and implementation of strategies to reduce water pollution in the Chesapeake Bay and its tributaries; and WHEREAS, the Cities of Portsmouth, Chesapeake, Hampton, Newport News, Norfolk and Virginia Beach are designated as "Phase 1" communities under Virginia's Municipal Separate Storm Sewer (MS4) Permits; and WHEREAS, to satisfy the requirements of the MS4 Permits and applicable law, the Phase 1 communities desire to contract with the Hampton Roads Planning District Commission (HRPDC) to implement water quality monitoring and analysis; and WHEREAS, the data obtained from the monitoring will permit the development of affordable and effective strategies to reduce water pollution and comply with applicable law; and WHEREAS, Portsmouth and the other Phase 1 communities each will be required to execute a Memorandum of Understanding (MOU) with HRPDC and contribute approximately $84,000 per year for five years; and WHEREAS, if Portsmouth conducted the monitoring and analysis independently, the cost would be an estimated $500,000 per year, and by entering into the MOU Portsmouth will save approximately $2,000,000 over five years; and NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that the City Manager is hereby authorized to enter into an agreement between the City of Portsmouth and HRPDC for implementation of a regional water quality monitoring and analysis program at a cost of approximately $84,000 per year for five years under such terms and conditions as he shall deem in the best interests of the City. BE IT FURTHER RESOLVED that the City Manager is further authorized to execute such other instruments and provide such other assurances as may be required in furtherance of the purposes set forth in this resolution.
