"Virginia Stormwater Management Program authority" or "VSMP authority" means <br />authority [such as the City of Portsmouth] approved by the State Board after September 13, <br />2011, to operate a Virginia Stormwater Management Program. <br />Sec. 31.2-2. Purpose and authorities. <br />(a) The purpose of this ordinance is to ensure the general health, safety and welfare of <br />the citizens of Portsmouth and to protect the quality and quantity of state waters from the <br />potential harm of unmanaged Stormwater, including protection from any land disturbing activity <br />causing unreasonable degradation of properties, water quality, stream channels, and other natural <br />resources, and to establish procedures whereby stormwater requirements related to water quality <br />and quantity should be administered and enforced. <br />(b) This ordinance is adopted pursuant to Article 2.3 (§62.1-44.15:24 et seq.) of Chapter <br />3.1 of Title 62.1 of the Code of Virginia and in compliance with 9VAC-25-870-20 and <br />9VAC.25-870-40 of the Virginia Stormwater Management Regulations. <br />(c) The Federal Clean Water Act requires the city to implement a stormwater <br />management program based on the regulations and requirements published by the United States <br />Environmental Protection Agency. <br />(d) The city is authorized by the Code of Virginia to construct, reconstruct, improve and <br />extend a stormwater utility system and to issue revenue bonds, if needed, to finance in whole or <br />in part the cost of such system and to establish just and equitable rates, fees and charges for the <br />services and facilities provided by the system. <br />(e) It is necessary and essential that the city provide for effective management and <br />financing of a stormwater system within the city to provide a mechanism for mitigating the <br />damaging effects of stormwater runoff on the environment and to improve the public health, <br />safety and welfare by providing for the sage and efficient capture and conveyance of stormwater <br />runoff, the improvement of water quality, and the correction of stormwater problems. <br />(f) Stormwater runoff is associated with all developed properties in the city, whether <br />residential or nonresidential, and the volume of each individual property's Stormwater runoff is <br />related to the amount of impervious and semi-pervious surface on the property. <br />(g) The .Administrator shall be responsible for the use, management, operation and <br />maintenance of the Stormwater system as prescribed by this chapter. The Administrator shall <br />have authority to establish procedures and to enforce regulations pertaining to the Stormwater <br />system. <br />Sec. 31.2-3. Stormwater permit requirement; exemptions. <br />(a) Except as provided herein, a person shall not conduct any land-disturbing activity <br />until they have submitted a permit application to the VSMP authority that includes a state VSMP <br />
