2014-21 <br />~: <br />AN ORDINANCE TO AMEND CHAPTERS 5 AND 6 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (2006) PERTAINING TO THE RIDING OF BICYCLES ON <br />THE SEAWALL AND ADJACENT AREAS ALONG THE ELIZABETH RIVER AND <br />ON SIDEWALKS IN THE CITY. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />I . That Section 5-66 of the Code of the City of Portsmouth, Virginia (2006) be <br />amended as follows: <br />Sec. 5-66. Riding on sidewalks or crosswalks. <br />(a) No person shall ride a bicycle on a sidewalk or crosswalk in an area where signs <br />indicate that such riding is prohibited. <br />(b) No person shall ride a bicycle upon and along a sidewalk, or across a roadway <br />upon and along a crosswalk, where such use of bicycles is prohibited by official traffic-control <br />devices. <br />(c) In locations where the riding of bicycles on sidewalks or crosswalks is not <br />prohibited: <br />(1) A person riding a bicycle upon and along a sidewalk, or across a roadway upon <br />and along a crosswalk, shall yield the right-of--way to any pedestrian and shall <br />give an audible signal before overtaking and passing a pedestrian and shall ride in <br />a single file. <br />(2) A person riding a bicycle upon and along a sidewalk, or across a roadway upon <br />and along a crosswalk, shall have all the rights and duties of a pedestrian under <br />the same circumstances. <br />(d) Violation of any provision of this section shall not be considered a traffic <br />infraction and shall be punishable by a fine of not more than $200.00. <br />2. That Section 6-5 of the Code of the City of Portsmouth, Virginia (2006) be <br />amended as follows: <br />Sec. 6-5. Use of or riding of roller skates, skateboards, or other similar devices on the <br />Seawall along the Elizabeth River or adjacent areas. <br />(a) No person shall use or ride on the seawall along the Elizabeth River or the areas <br />adjacent to the seawall designated as the Portside Festival site any skateboards, toys or similar <br />related devices on wheels or runners. This provision shall not be applicable to the use of <br />wheelchairs for transportation of handicapped persons or the use of baby carriages, strollers or <br />related modes of transportation for infants, who are accompanied by a parent or guardian. The <br />use of roller skates shall be permitted only in areas so designated by markings provided by the <br />city's traffic engineering department for that specific use or activity. <br />(b) The use or riding of bicycles in those areas designated in subsection (a) of this <br />section shall be permitted except where signs indicate that such use or riding is prohibited. <br />(c) Violation of any provision of this section shall be punishable by a fine of not <br />more than $200.00. <br />
