<br />2. That Dana Harris is hereby granted a use permit pursuant to Section 40.1-2.3(B) of the <br />Code of the City of Portsmouth, Virginia (2006) for the operation of a family child day care <br />home at 4005 Ebbtide Lane, and being more particularly described as: <br /> <br />UP-13-11 <br /> <br />4005 Ebbtide Lane <br /> <br />Beginning at a point 84.66':!: west of the northwest comer of <br />Ebbtide Lane and Long Point Boulevard; thence, in a westerly <br />directionI17.55':!: to a point; thence, a northerly direction 112.00':!: <br />to a point; thence, in a easterly direction 70.51 ':1: to a point; thence, <br />in a southerly direction 112.00':!: to a point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) Days and hours of operation shall be Monday through Friday from 6:30 <br />a.m. to 8:30 p.m. <br /> <br />(b) Four off-street parking spaces shall be maintained within the applicant's <br />driveway during the facility's days and hours of operation to <br />accommodate one space for the full-time staff member and three spaces <br />for the drop off/pick up of children. <br /> <br />(c) The facility shall be operated in compliance with applicable codes, <br />ordinances and regulations of federal, state and local government, and all <br />required licenses and permits shall be obtained and remain in effect during <br />the operation of the family child day care home. <br /> <br />(d) All taxes/fees associated with the property shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on <br />September 24,2013. <br /> <br />Teste: <br /> <br />City Clerk <br />
