<br />2. That Mt. Carmel Missionary Baptist Church is hereby granted a use permit pursuant to <br />Section 40.1-2.3B of the Code of the City of Portsmouth, Virginia (2006) for the operation of a <br />child day care center at 3310 Deep Creek Boulevard and 17-27 Manly Street, and being more <br />particularly described as: <br /> <br />UP-13-07 <br /> <br />3310 Deep Creek Boulevard <br />17-27 Manly Street <br /> <br />Beginning at the southwest comer of the intersection of Deep <br />Creek Boulevard and Portsmouth Boulevard, then running west for <br />a distance of 333 feet along the right-of-way of Portsmouth <br />Boulevard, then running south for 98 feet, then running west for 56 <br />feet, then running south for 101 feet, then running east along the <br />northern right-of-way of Manly Street, and then running 223 feet <br />in a northeasterly direction along the right-of-way of Deep Creek <br />Boulevard to the point of beginning. The property is addressed as <br />3310 Deep Creek Boulevard and 17 through 27 Manly Street and <br />is further described as Tax Map 157, Parcels 16 through 21. <br /> <br />3. Thatthe use permit is approved subject to the following conditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) The occupant load of the facility shall not exceed 48 children at any time <br />as required by the Building Official. <br />(b) The hours of operation shall be 6:30 a.m. to 6:30 p.m., Monday through <br />Friday. Use of the outdoor playground shall be limited to the hours of <br />8:00 a.m. to 6:00 p.m. <br />(c) Prior to the issuance of any building permits, the applicant must have <br />submitted a complete set of building plans and specifications for all <br />existing conditions and improvements, and the submittals shall have been <br />approved by the City. <br />(d) All existing conditions and the playground area shall comply with all <br />requirements determined to be applicable by the Building Official and the <br />Fire Marshall's Office. <br />(e) The applicant shall obtain approval from the Historic Preservation <br />Commission for any exterior alterations, including signage and the <br />playground area. <br /> <br />4. The applicant must obtain and keep current any required operating <br />licenses and shall operate in accordance with federal, state and local regulations. <br />
