R-13-21 A RESOLUTION GRANTING APPROVAL FOR AMERICAN LIFELINE MEDICAL TRANSPORT, INC., TO PROVIDE CERTAIN TRANSPORT SERVICES WITHIN THE CITY OF PORTSMOUTH. WHEREAS, Section 15.2-955 of the Code of Virginia provides that no organization shall provide emergency medical services (EMS) without the prior approval by resolution of the local governing body; and WHEREAS, Virginia Administrative Code regulations, specifically 12 V AC 5-31-420, also require that an EMS agency receive an ordinance or resolution from the governing body of each locality where the agency maintains an office or stations an EMS vehicle for response within a locality; and WHEREAS, American Lifeline Medical Transport, Inc., a private emergency medical services agency, desires a resolution supporting a state license to provide certain medical transport services in the City of Portsmouth, Virginia. NOW THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, that: 1. American Lifeline Medical Transport, Inc., ("American") is hereby granted approval to provide certain medical transport services within the City of Portsmouth, Virginia and to obtain agency license approval from the Virginia Office of Emergency Medical Services in accordance with the following requirements which shall apply when American is providing services within the City of Portsmouth: (a) American shall limit its transport services to nonemergency transports when operating in the City of Portsmouth. (b) . American shall not attempt to provide service to, nor shall it respond to, emergency situations (commonly known as "911 Calls") within the City unless requested by an authorized official of the Portsmouth Department of Fire, Rescue, and Emergency Services or through a written agreement with the City. (c). American shall immediately report any emergency situation that it enco.unters in the normal course of its transport business within the City of Portsmouth to the dispatch center to be handled by the Department of Fire, Rescue, and Emergency Services. (d) American shall comply with all applicable federal, state and local laws and regulations, maintain a valid Virginia Department of Health Office of Emergency Medical Services license and a valid business license, pay all federal, state and local taxes, and keep its transport vehicles and medical equipment in a safe, neat, well-maintained and sanitary condition. 2. The Fire Chief is hereby authorized by City Council to enforce the terms of this resolution. If the Fire Chief determines that there has been a material violation of any provision hereof, or any other conduct that places public safety or the public interest at risk, he shall report it to the
