That the applicant is hereby granted a use permit pursuant to Section 40.1-2.3(B) of <br />the Code of the City of Portsmouth, Virginia (2006) to operate a pharmacy with drive-through <br />facilities at 5815, 5821, and 5829 High Street, 3125 Tyre Neck Road, and 5830 Trucker Street, <br />Portsmouth, Virginia, and being more particularly described as: <br /> <br />UP-ll-05 <br /> <br />5815, 5821, and 5829 High Street, <br />3125 Tyre Neck Road, <br />5830 Trucker Street <br /> <br />Beginning at a point, being the intersection of the south line <br />of High Street West and the east line of Tyre Neck Road; <br />thence along the said south line of High Street West S <br />85045'06" E, 567.13' to a point; thence leaving the said <br />south line of High Street West S 06030'15" W, 299.99' to a <br />point; thence N 85045'02" W, 25.02 to a point on the north <br />line of Trucker Street; thence along the said north line of <br />Trucker Street N 85045'02" W, 542.26' to a point on the <br />east line of Tyre Neck Road; thence leaving the said north <br />line of Trucker Street along the said east line of Tyre Neck <br />Road N 06031 '58" E, 300.00' to the point and place of <br />beginning, containing 3.903 acres. <br /> <br />3. That the use permit is approved subject to the followingcQnditions which shall be <br />observed by the applicant and any successor in interest: <br /> <br />(a) The lane widths for Eastbound High Street shall be: <br />Inside lane: 11 ft. <br />Outside lane: 12 ft. <br />Right turn lane: 12.6 to 13.1 ft. <br />(b) Northbound right turn movement driveway (onto High St.) shall be striped <br />with six-foot continental style crosswalk. <br />(c) Southbound full movement driveway (onto Trucker St.) should be striped <br />with six-foot. continental style crosswalk. <br />(d) Westbound full movement driveway (onto Tyre Neck Rd.) shall be striped <br />with six-foot continental style crosswalk. <br />(e) The site shall be developed in substantial compliance with the site plan <br />submitted by Kimley-Horn dated November 14, 2012. <br />(f) The building shall be developed in conformance with the submitted <br />elevations dated November 15, 2012 <br />(g) The recommendations of the Traffic Impact Analysis created <br />November 2012 must be installed at the developer's expense. <br />
