<br /> R-13-01 <br /> A RESOLUTION AUTHORIZING AN APPLICATION FOR FEDERAL FUNDING <br /> ASSISTANCE FROM THE LAND AND WATER CONSERVATION FUND TO THE <br /> VIRGINIA DEPARTMENT OF CONSERVATION AND RECREATION AS PROVIDED <br /> IN THE LAND AND WATER CONSERVATION FUND ACT OF 1965, AS AMENDED. <br /> WHEREAS, under the provisions of the Land and Water Conservation Fund (L WCF), <br /> federal funding assistance is available to aid in financing the cost of qualifying facility <br /> development; and <br /> WHEREAS, the City Council considers it in the best public interest to complete the <br /> development project at the Paradise Creek Nature Park in the City of Portsmouth as described in <br /> the application. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br /> Virginia: <br /> 1. That the City Manager be and hereby is authorized to make formal application to <br /> the Virginia Department of Conservation and Recreation (DCR) for funding assistance. <br /> 2. That any fund assistance received will be used for the construction of a kayak and <br /> canoe launch, a parking lot addition, and an outdoor pavilion at Paradise Creek Nature Park <br /> within the specified time frame. <br /> 3. That the City Council hereby certifies that project funding is currently available <br /> and is committed for this project. <br /> 4. That City Council is aware that the grant, if approved by the National Park <br />~. Service, will be paid on a reimbursement basis, and that the City may only request payment after <br /> eligible and allowable costs have been paid to vendors and evidence of such has been provided to <br /> DCR in the required format. <br /> 5. That City Council acknowledges that any property acquired and/or developed <br /> with financial aid from the L WCF must be placed in use and retained in perpetuity as a public <br /> outdoor recreation area in accordance with the provisions and requirements of the Land and <br /> Water Conservation Fund Act of 1965, as amended. <br /> 6. That City Council acknowledges that any non-recreational uses may not be made <br /> of the property without undergoing a conversion of use process and obtaining approval from the <br /> Department of Conservation and Recreation and the U.S. Department of Interior! National Park <br /> Service. <br /> 7. That City Council acknowledges that the City of Portsmouth is responsible for <br /> compliance with the National Environmental Policy Act, Endangered Species Act, Historic <br /> Preservation Act, Executive Orders 11988 and 11990 (Floodplain Management and Wetlands <br /> Protection) and all other applicable state and federal laws. <br />
