<br />1. That, coupled with the terms imposed by paragraph 2 hereof, the <br />following conditions exist: <br /> <br />(a) The proposed complies with the applicable standards of the City Zoning <br />Ordinance; <br /> <br />(b) The proposed use is consistent with the comprehensive plan; <br /> <br />( c) The proposed use is compatible with the character of surrounding lands <br />and the uses permitted in the zoning district(s) of surrounding lands; <br /> <br />(d) The proposed use is configured to minimize adverse effects, including the <br />visual impacts of the proposed use on adjacent lands; <br /> <br />(e) The proposed use avoids significant deterioration of water and air <br />resources, and other natural resources; <br /> <br />(f) The proposed use maintains safe and adequate egress and ingress onto the <br />site, and safe road conditions around the site; <br /> <br />(g) The proposed use allows for the protection of property values and the <br />ability of neighboring lands to develop the uses permitted in the zoning <br />districts; and <br /> <br />(h) The use complies with all other city, state, and federal laws and <br />regulations. <br /> <br />2. That all conditions originally imposed on the subject property are <br />repealed. The applicant and any successor in interest shall be subject to the following <br />conditions: <br /> <br />(a) The applicant shall be responsible for the cost of <br />establishing and or ijpgrading the necessary utilities. <br />(b) The applicant shall adhere to the approved trash handling <br />plan which includes private trash pickup. <br />(c) All taxes and fees associated with the proposed project <br />shall be paid when due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under <br />Section 40.1-2.3 of the Code of the City of Portsmouth, Virginia (2006), the housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within two years of the adoption of this resolution. <br />
